Personal injury refers to any physical, emotional, or financial harm caused by another person’s negligence. These cases can arise from car accidents, unsafe property conditions, medical errors, or even dog attacks. These injuries can often leave victims facing medical bills, lost income, or long term suffering.
At Krall Law Offices, we understand how life can change in an instant due to someone else’s negligence. Personal injury law is designed to protect individuals who have been physically, emotionally, or financially harmed because of another party’s actions or failure to act.
Personal Injury Law Basics
To succeed in a personal injury claim, you typically must prove the four elements of negligence.
- The other party had a duty to act responsibly.
- They breached that duty through action or inaction.
- That breach directly caused your injury.
- You suffered damages as a result of their negligence.

How Long Does a Personal Injury Lawsuit Take?
We always tell our clients that you unfortunately cannot predict the length of time that a personal injury lawsuit takes. From start to finish, it can take several months up to a few years.
One of the reasons that the case length differs so much is because during a personal injury lawsuit, there are multiple opportunities for you to settle, and there are many factors that go into the settlement decision.
We would recommend checking out our blog post on the lawsuit timeline for a more in-depth look at the different stages, how long you can expect them to take, and what our office is doing for you during each stage.
How Much is My Case Worth?
One of the biggest questions our clients ask us throughout their case is how much we think their case is worth. We are also frequently asked by our clients whether we believe that they should take a settlement offer. The answer differs so much depending on the client. While we may be able to offer you an opinion based on experience, we cannot tell you what you should or should not do.
Based on how responsive the insurance adjusters are for the negligent party; the settlement offer may not be what we call a “good faith” offer. This means that in the negotiation process, we may ask for an amount and the insurance adjuster typically counters that with a smaller amount. However, if the insurance adjuster begins with an offer much less than what we asked for and refuses to budge, this would not be a “good faith” offer because it shows that the negligent party is unwilling to negotiate.
Another factor that alters settlement amount is that different people may place different value on their injuries. Some people may get into a car accident and want to settle primarily to pay their medical bills. Others may be terrified to drive a car ever again and therefore might want a higher settlement amount reflecting their pain and suffering.
It is our job as your attorneys to investigate throughout the process, collect the evidence, and consult with you to help arrange the best possible outcome for your unique needs.
Common Misconceptions
Personal injury cases are not just about compensation: they are about accountability. Many people believe that people file personal injury lawsuits as an easy way to make money, but this isn’t the truth. Our clients come to us because they are hurt, through no fault of their own, and they need help.
Personal injury cases are difficult. The uncertainty of what is coming next, whether you will be compensated fairly, or how your life will be changed are overwhelming. Our office wants to prioritize your wellbeing and overall mental health through this process. Holding the negligent party responsible helps prevent future harm and ensures that victims aren’t left to bear the burden alone.
